Chef charged with rape reappears in court for PI

The preliminary inquiry in the matter of Oswin Barker, the 37-year-old chef accused of rape, began in the Magistrate’s Court today, April 30 in the form of paper committal.

The Crown is being represented by Chrislyn Benjamin and the defendant by Stephen Daniels.

Barker, who was offered bail by Magistrate Tamia Richards, was not required to plead to the indictable matter. He was granted bail in the sum of $75,000, with two signed sureties; $15, 000 of the bail was required to be paid in cash.

Barker, who first appeared in court on March 26, resides at East End and allegedly committed the act sometime between March 21 and 22, 2012 at the Brandywine Bay beach.

The court heard that the defendant had allegedly taken the virtual complainant (VC) and her friend to a bar in Long Bush, and sometime after, he took the VC’s friend home but drove past the VC’s residence to the Brandywine Bay area, even though the complainant protested.

The complainant allegedly asked the defendant where he was going and he reportedly told her he wanted to speak to her. She allegedly asked the defendant to take her home, stating that she was sleepy and tired.

It was stated that Barker told the VC that he liked her a lot and asked her if she couldn’t see that. He also reportedly told her that he would do anything for her and that’s why he and his girlfriend were not presently on good terms.

During the alleged rape, the VC reportedly punched the defendant in his face and bit him in his chest.

It was announced that when officers informed the defendant of the report made against him, he said: “Me? Not me officer. I never raped that girl.”

However, the defendant stated that he did have sexual intercourse with the VC on more than one occasion and that the VC was his girlfriend.
