Chief Justice rules recount results valid, APNU agent appeals decision

Georgetown: In order to further cling onto government illegally in the aftermath of a ruling by Chief Justice Roxane George Monday, which stated that the national vote recount is valid and no other figures can be used to declare the results of the March 02 polls, President David Granger through his agents in the APNU/AFC has requested time to appeal the ruling.

Granger has repeatedly tried to subvert and interfere with the declaration by the Guyana Elections Commission (GECOM) by abusing the court process along with disregarding the constitution.

Chief Justice Roxane George Monday afternoon ruled that ruled that Section 22 of the Elections Laws (Amendment) Act is constitutional as determined by a ruling of the Court of Appeal, effectively determining that it was lawful enact Order 60 of 2020, i.e. the recount order.

Further, the CJ ruled that the recount results arising out of Order 60 are valid as already decided by Caribbean Court of Justice (CCJ).

Noting that the submissions by the applicant, Misenga Jones are “hopelessly flawed”, the CJ said the CCJ judgment came to the “ineluctable conclusion” that the recount votes are valid.

GECOM is seeking to make a declaration of the March 2 polls based on the certified recount results which shows that the PPP/C won the elections with 233,336 votes. However, the Chief Elections Officer Keith Lowenfield has refused, on numerous occasions, to submit his final elections report using the recount figures – in direct defiance of instructions given to him by Chairwoman Justice Claudette Singh.

Former Attorney General Basil Williams pleaded that the Guyana Elections Commission (GECOM) takes no action until an appeal is filed.

The notice that an appeal would be filed was first made by one of Granger’s candidate, Roysdale Forde. He acted as an attorney for Granger’s Coalition agent Misenga Jones, who had moved to the court to get the recount nullified and for GECOM to use figures generated before the recount declarations were made.

Chief Justice Roxane George ruled that the recount overtook previous declarations and those declarations cannot be resurrected and used.

Kim Kyte-Thomas, attorney for Justice Claudette Singh, the Chair of GECOM, told the Court that Justice Singh would not act once the appeal is filed by Tuesday. If this is allowed, then the abuse of the court will cycle all the way to the CCJ once again.
