Commissioner Gibbs faces lawsuit over purchase of light aircraft

Piarco: Police Commissioner Dwayne Gibbs has been served with a pre-action protocol letter  following the lease of a light aircraft from Trinidad and Tobago Air Support Services.

The managing director of Navi Comm Avionics Limited Eddie Dalsingh today instructed his attorney Jacqueline Chang of Trinity Chambers to institute legal action against
Commissioner Gibbs.

Dalsingh says his attorneys are of the view that the Trinidad and Tobago Police Service and moreso the Commissioner of Police is not in law a seperate legal entity which possesses the capacity to enter into wrtten contracts.

Attorney Chang who has filed the pre action protocol letter says the powers of the commissioner are clearly defined in secton 123-A of the Constitution, the Police Service Act and Police Service Regulations which does not stipulate that the Commissioner is a body corporate or a company that is capable of entering into contracts.

Dalsingh through his attorneys have deemed the contract null and void.

Navi Comm Avionics Limited is demanding that the Commissioner rescind all arrangements with TT Air Support Company Limited within 14 days, failing which High Court proceedings will be instituted against the Commissioner of Police seeking to declare the contract dated December 29th with TTASC null and void.

The contract with Trinidad and Tobago Air Support Limited is for the provision of 720 hours of use of a Zenith CH-750 Air Scout aircraft over a 12-week evaluation period.

The contract is said to be valued at over TT$900,000.
