Constitutional motion being filed against magistrate today

Bridgetown.

Attorney at law Arthur Holder, is filing a consitutional motion against  Magistrate Graveney Bannister today, the motion is being filed in relation to a case where self confessed drug user Jason Levere Griffith, was fined and then remanded when he appeared in the District "A" Magistrates Court last week.

Griffith  pleaded guilty to possession of cannabis with intent to suppy and having a traffickable quantity of the drug on April 14. Bannister fined him $1000 by April 30 and $1000 days in prison for possession simple prossession and $1000 by May 30 or 100 days in prison for possession with intent to supply.

However,  Griffith was remanded until Friday after he was unable to secure a surety and it is this aspect which is being challenged by Holder,  stressing that Griffith was deprived of his liberty for five days, Holder said he asked the court why Griffth was remanded after pleading guilty.

According to Holder, he was told Griffith needed a surety and could not find one and was therefore remanded.

He is therefore filing a motion in the High Court against the magistrate seeking a declaration that his order to remand Griffth was unconstitutional, null and void and of no effect.
