Berbice. Thakumarie, 65, who was accused of killing her husband Yodha on April 27, 2008, has been freed of the indictment by a mixed Berbice jury.
Justice James Bovell-Drakes told the widow to leave the court for she is now free, after he handed down the verdict to the woman who has a hearing impediment.
Earlier Justice Drakes addressed the jury before they were sent to deliberate on the evidence.
Police Detective Corporal Duke Jacque said the accused had shown him a piece of wood that the accused said she used to lash her husband.
Pathologist Dr Nehaul Singh, who also gave evidence during the trial testified that the incise wound found on the body of Yodha had been caused by a sharp instrument, notably a chisel, scissors, bottle, cutlass, knife, zinc, or glass.
Singh, while confessing that his opinion may be different from other persons in the medical field, noted that his knowledge led him to believe that a piece of wood was not a sharp instrument. These facts, Justice Drakes told the jury they have to take into consideration before they can come up with a verdict of guilty or not guilty.
He also advised the jury that no negative conclusion should be derived from the choice made by Thakumarie (the accused) to stand in the docks, and give a statement. From the docks, she could not be crossed-questioned on her story.
Justice Drake also asked the jury to consider that the piece of wood tendered by the prosecution had six sides and was not sharp. Statements by the deceased’s brother were also deliberated on.
He said that Yodha refused to see a doctor after he was injured. The pathologist testified that should the injury remain untreated, it would have resulted in death, due to extensive hemorrhaging.
Yodha, 65, died as a result of extensive bleeding which resulted in shock and hemorrhage at his Rosignol Village home on April 27, 2008.
The trial which opened in June was prosecuted by State Counsel Rhondel Weaver. Thakumarie was represented by Defence Counsel Rabindranauth Singh.
