Raul Garica won his case against the Government of Barbados and the Chief Immigration Officer in the Number Six Court yesterday, when Justice Judge Margaret Reifer ruled that his continued detention was unlawful.
The former drug dealer remains in the custody of the Immigration Department after Justice Refier informed the Court that he would only released when his lawyers and Immigration officials conceive a joint plan for Garica's conditions for staying in Barbados, and where he will stay.
Justice Reifer told the Court, she will have to consider the plan before endorsing it and only then would Garica be released
David Comissiong the lead attorney for Garica described the judge's decision as a victory but admitted there is still work to be done.
"I will be working on this immediately. I don't want the other side to be dragging their feet on this", Comissiong told the press.
